TERMS AND CONDITIONS

PRICES:

All prices are subject to change without notice and supersede those of all previous lists. Quoted prices are good for 30 days from date of quote, unless otherwise stated. Possession of a price list will not be accepted by Cascade Equipment Ltd., as an obligation, or offer to sell any goods listed therein.

TAXES:

All taxes are extra.

FREIGHT TERMS:

All shipments are F.O.B. ground our Calgary, AB warehouse. Where customer does not have a specified courier and account, all freight charges will be invoiced and charged to the purchaser’s account. Where customer requests that items be shipped other than Cascade Equipment Ltd.’s normal method, the cost will be invoiced and charged to customer account.

PAYMENT TERMS:

Net 30 days O.A.C from invoice date.

RETURNS:

Returns must be pre-authorized in writing, be accompanied with the relevant customer purchase order, Cascade Equipment Ltd. RGA number and are subject to acceptance before any credit is issued. Return goods must be unused, and in resalable condition. Any parts or service required to ensure product is suitable for re-sale will be billed to customer. Returned goods will be subject to a restocking charge of 25% on stock items within 15 days from date of invoice, unless otherwise specified or by the discretion of Cascade Equipment Ltd Cascade Equipment Ltd. reserves the right to decline any return over 30 days from date of invoice. Products sold on a cash basis will not be accepted as returns. Freight for any returned goods shall be charged to the purchaser’s account. Obsolete or used products shall not be accepted for return under any circumstances. Non-Stock / Special Order Items / Parts / Cash Sales Items non-returnable.

DISCREPANCIES/SHORTAGES:

All claims for shortages and/or inaccurate filling of orders shall be made within five working days after buyer’s receipt of material.

WARRANTY:

All products sold by Cascade Equipment Ltd. found to be defective due to Faulty workmanship or material will be replaced without charge provided in each case that product was properly installed and is being used for the service for which Cascade Equipment Ltd. and the manufacturer recommends and that written notice, specifying the alleged defects is presented to Cascade Equipment Ltd. within one year from date of invoice. Thereafter Cascade Equipment Ltd. shall not be liable in any respect for any defective products. Cascade Equipment Ltd. shall in no circumstances be liable for any claims for labour, installation costs, damages or other special or consequential damages including but not limited to loss of revenue or profits, or other expenses incurred by reason of the use or sale of any material products found to be defective. This warranty shall not apply to any product which is modified or changed in design or function after leaving the Cascade Equipment Ltd. warehouse.

DELIVERIES:

Stock Items quoted are normally available for immediate shipment but subject to prior sale. Cascade Equipment Ltd. shall not be liable for any direct, indirect or consequential damage or loss caused by delay in delivery, regardless of the cause of delay including fire, accidents, flood, riots, strikes, transportation delays, labour or material shortages or any other cause.
